Joseph E. Zdarsky and Gerald T. Walsh were named Top Rated Business Litigation Attorneys, while Guy J. Agostinelli was named Top Rated Business & Corporate Attorney.  Zdarsky was also named to the Top Fifty Attorneys list.

Mr.  Zdarsky is a founding partner of Zdarsky, Sawicki & Agostinelli LLP and has practiced business litigation in the state and federal courts and in arbitrations for over 45 years. He has handled a wide variety of complex cases involving contracts, corporate governance, fiduciary liability, professional liability, partnership, and joint venture disputes, fraud, unfair competition, and other commercial matters, including unique cases involving federal Indian law. He also has represented attorneys and law firms regarding partnership disputes, malpractice claims, and professional discipline. Mr. Zdarsky has handled numerous trials and appeals, including arguments before the New York Court of Appeals and the United States Supreme Court. 

Mr. Agostinelli concentrates his practice in the fields of corporate and commercial transactions, real estate development, financing and negotiation, and litigation with respect to construction matters. He is counsel to a wide variety of businesses as well as to real estate developers and general construction contractors. Mr. Agostinelli routinely handles engagements pertaining to mergers, acquisitions, asset-based and revolving credit financing transactions, development agreements, and design-build and construction contracts. He has also been engaged on behalf of parties in complex litigation and arbitration proceedings.

Mr. Walsh, a Buffalo, New York native and a 1981 cum laude graduate of the University of Notre Dame, represents a diverse group of clients in complex litigation matters in federal and state courts throughout New York State. As a founding partner of Zdarsky Sawicki & Agostinelli LLP, Mr. Walsh has a wealth of experience handling: business litigation; contract negotiation and litigation; trade secret and non-compete issues; partnership, LLC, and corporate disputes and dissolutions; trademark and copyright registrations and claims; employment and discrimination litigation; regulatory compliance; whistleblower claims; significant first-party insurance disclaimer litigation; physician contracts and disciplinary proceedings involving hospitals, health care insurers and state agencies; serious personal injury litigation; and federal criminal trials.  Based on the firm’s unique, longstanding Native American Law experience, Mr. Walsh represents numerous clients engaged in commerce with sovereign Indian Nations located within the territorial boundaries of New York State.  Mr. Walsh has prosecuted and defended appeals in New York State, in the Second and Third Circuit United States Courts of Appeals, and in the United States Supreme Court.
