Case Summary: | Bingo hall operators brought an action to enjoin anti‑gambling protestors from picketing and interfering with bingo operation and gasoline business on the Tuscarora Indian Reservation. The New York Attorney General brought a separate action seeking to enforce alleged tribal law against gambling. Supreme Court, Niagara County, granted the operators’ motion for preliminary injunction and dismissed the Attorney General’s claim. On appeal the Appellate Division held that the Attorney General lacked standing to enforce tribal law; the protestors did not have sovereign immunity, and the action was within the court’s subject matter jurisdiction, and affirmed the decision of the lower court. |
