Deloitte & Touche LLP v. Chiampou

Matter Name: Deloitte & Touche LLP v. Chiampou
Client Name:Charles Chiampou and Robert Travis
Case Summary: Accounting firm brought action to enforce a non‑solicitation provision in Partnership Agreement. Although the trial court had granted a preliminary injunction, the Appellate Division modified the injunction, first on motion and later confirmed on the appeal, to exempt 34 additional clients, representing the significant part of the defendants’ practice, from the scope of the preliminary injunction. The court found that such clients had voluntarily and without solicitation sought out the defendants after the defendants left plaintiff’s firm.
